Welcome to ClearWaterPath ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at clearwaterpath.rest (the "Service") operated by ClearWaterPath.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
ClearWaterPath offers top-tier yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are provided subject to availability and adhering to weather restrictions. We maintain the right to alter or cease services as necessary.
3. Booking and Reservations
3.1 Booking Process
When booking a charter, you must:
- Be at least 18 years old
- Furnish complete and truthful information
- Remit the required deposit as denoted in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking becomes official only after we confirm receipt of payment and send a written confirmation. We retain the authority to reject providing services at our discretion.
3.3 Availability
Charter services depend on both the availability of vessels and favorable meteorological conditions. We commit to making reasonable efforts to honor your preferred scheduling.
4. Payment Terms
4.1 Pricing
Prices are presented in € and include all applicable taxes unless stated otherwise. Note that prices may be revised without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the overall cost of the charter is required upon booking
- Final Payment: Due 48 hours before the charter sets sail
- Extra charges, if any: To be settled following the charter's conclusion
4.3 Payment Methods
We accept most major credit cards, electronic bank transfers, and certified bank checks. All payments are processed using secure, encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With over 72 hours before departure: Full refund less transaction fees
- Between 24 to 72 hours before departure: 50% refund
- With less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
Should the captain deem weather conditions as unsafe, we will propose either:
- A courtesy rescheduling of the charter at no extra cost for the next available date
- A full refund if we cannot reschedule
5.3 Mechanical Issues
If a mechanical malfunction occurs with the assigned yacht, we will strive to supply a comparable alternative. If no substitute is accessible, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are required to:
- Next to fortify instructions from the crew
- Put on the provided safety gear if needed
- Inform of any health issues that might affect their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
It's forbidden to bring the following items aboard:
- Glassware
- Unlawful substances
- Weapons of any kind
- Excessive amounts of beverages beyond moderate personal consumption
- Animals (unless prior authorization is given)
6.3 Conduct
Passengers are expected to behave in a manner that is respectful to all. We reserve the right to terminate a charter prematurely and without a refund if passenger behavior constitutes a risk to safety or disrupts the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our liability is restricted to the payment made for the charter. We are not liable for:
- Injuries that occur due to passengers’ negligence
- Thefts or damages to personal belongings
- Indirect or consequential damages, or those of a penal nature
- Delays resulting from atmospheric conditions or other factors outside our control
7.2 Insurance Coverage
Our fleet is insured with full marine insurance that covers our vessels and general operations. However, passengers should secure their own travel and personal insurance.
7.3 Assumption of Risk
By participating in our yachting services, you recognize the inherent perils of such activities and willingly accept personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We claim the right to adjust itineraries, routes, or schedules based on factors like climate considerations, safety, or operational needs. Efforts will be made to offer equivalent alternatives where possible.
9. Force Majeure
Our responsibility does not extend to postponements or modifications stemming from events outside our control, inclusive of but not constrained to:
- Severe meteorological conditions
- Natural disasters
- Regulative actions by government
- Closings of ports
- Technical failures
10. Privacy and Data Protection
How we handle your private data is in congruence with our Privacy Policy. By utilizing our services, you give consent for the collection and application of your data as described within our Privacy Policy.
11. Intellectual Property
All materials on our website, encompassing text, images, logos, and graphics, are shielded by copyrights and trademarks. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
The applicability of these Terms is subject to laws in force in Italy. Disputes, if any, shall be adjudicated by courts within Sorrento, Italy.
13. Changes to Terms
We withhold the right to modify these Terms periodically. Updates will be publicized via our website with notice of the revision date. The continual usage of our services indicates acceptance of the revised terms.
